These Terms of Service (“Terms”) govern your access to and use of the Global Pigeon Network (“GPN,” “we,” “our,” or “us”) website, applications, services, content, memberships, communications, and related platforms (collectively, the “Services”).

Global Pigeon Network is owned and operated by Ceteris Partners LLC, a South Carolina limited liability company.

By accessing, creating an account, purchasing a membership, or using the Services, you agree to be legally bound by these Terms.

If you do not agree to these Terms, you may not access or use the Services.

1. Eligibility

You must be at least 13 years old to use the Services. If you are under the age of majority in your jurisdiction, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

By using the Services, you represent and warrant that:

• You have the legal authority to enter into these Terms
• All information you provide is accurate
• You will comply with all applicable laws and regulations
• You are not prohibited from using the Services under applicable law

We reserve the right to refuse access to any person or entity at our sole discretion.

2. Account Registration and Security

To access certain features, users may be required to create an account. You are responsible for:

• Maintaining the confidentiality of your login credentials
• Restricting access to your account
• All activities occurring under your account
• Providing accurate and current information

You agree to notify us immediately of any unauthorized access or security breach.

We reserve the right to suspend, restrict, or terminate accounts at any time and for any reason.

3. Memberships, Payments, and Billing

GPN operates as a paid membership platform. Certain features, services, or areas of the platform may require payment of membership fees, subscription charges, recurring billing fees, or other payments.

By purchasing a membership or subscription, you agree:

• To pay all applicable fees and taxes
• To provide valid payment information
• To authorize recurring charges where applicable
• That subscriptions may automatically renew unless canceled

Payments are processed through third-party payment processors, including Stripe. We do not directly store complete payment card information on our servers.

We reserve the right to change pricing at any time, modify subscription plans, refuse or cancel transactions, suspend access for failed or disputed payments, use collections or legal remedies for unpaid balances, and offer promotional pricing at our discretion.

Unless otherwise stated, membership fees are non-refundable. Users are responsible for canceling subscriptions before renewal dates if they do not wish to continue service.

4. User Content

The Services allow users to upload, post, publish, transmit, display, and share content including text, photographs, videos, comments, messages, usernames, profile information, and other materials (“User Content”). You retain ownership of your User Content.

However, by posting or submitting User Content through the Services, you grant GPN and Ceteris Partners LLC a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, modify, display, distribute, publish, share, promote, and use your User Content for purposes related to operating, improving, marketing, and providing the Services.

You represent and warrant that:

• You own or control the rights to your User Content
• Your User Content does not violate any law or third-party rights
• Your User Content is not defamatory, obscene, fraudulent, or unlawful

You are solely responsible for your User Content and interactions with other users. We are not responsible for User Content posted by users.

5. Prohibited Conduct

Users agree not to:

• Violate laws or regulations
• Post illegal, harmful, threatening, abusive, or defamatory content
• Harass, intimidate, stalk, or threaten others
• Upload malware, viruses, or malicious code
• Engage in spam, scams, or deceptive practices
• Impersonate individuals or organizations
• Access accounts without authorization
• Attempt to interfere with platform security or operations
• Use automated bots or scraping tools without permission
• Infringe intellectual property rights
• Sell or transfer accounts without permission
• Post pornography, exploitative content, or unlawful material
• Encourage illegal activity or circumvent bans or restrictions
• Use the platform for unlawful commercial activities

We reserve the right to investigate and take action against violations, including content removal, suspension, termination, or legal action.

6. Community Moderation

GPN reserves the right, but not the obligation, to monitor activity and content, remove content at our discretion, restrict visibility of content, suspend or terminate accounts, and investigate reports and complaints.

We are not obligated to review all content and make no guarantees regarding moderation decisions. Moderation actions may occur with or without notice.

7. Intellectual Property

Except for User Content, all platform content, software, branding, logos, graphics, designs, text, features, and technology are owned by or licensed to GPN and Ceteris Partners LLC. No rights are granted except as expressly stated.

Users may not copy or reproduce platform materials, reverse engineer the Services, use trademarks without permission, or create derivative works from platform content.

The name “Global Pigeon Network,” “GPN,” associated branding, logos, and visual elements are protected intellectual property.

8. Copyright Complaints

We respect intellectual property rights. If you believe content infringes your copyright, you may submit a complaint containing:

• Your contact information
• Identification of the copyrighted work
• Identification of the allegedly infringing material
• A statement made in good faith
• A statement under penalty of perjury
• Your physical or electronic signature

We reserve the right to remove allegedly infringing content and terminate repeat infringers.

9. Third-Party Services

The Services may contain links, integrations, advertisements, or connections to third-party websites and services. We are not responsible for third-party content, policies, services, or transactions with third parties. Your interactions with third parties are solely between you and those third parties.

10. Privacy

Your use of the Services is also governed by the GPN Privacy Policy. By using the Services, you consent to the collection, use, and disclosure of information as described in the Privacy Policy.

11. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, SECURITY, AND AVAILABILITY.

WE DO NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT CONTENT WILL BE ACCURATE, THAT THE PLATFORM WILL BE SECURE, OR THAT DEFECTS WILL BE CORRECTED. YOUR USE OF THE SERVICES IS AT YOUR OWN RISK.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GPN, CETERIS PARTNERS LLC, ITS OWNERS, MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND AGENTS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, LOST PROFITS, LOST DATA, BUSINESS INTERRUPTION, USER CONDUCT, USER CONTENT, ACCOUNT ACCESS ISSUES, SECURITY BREACHES, OR SERVICE INTERRUPTIONS.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE GREATER OF THE AMOUNT PAID BY YOU TO GPN IN THE PRIOR TWELVE MONTHS, OR ONE HUNDRED U.S. DOLLARS ($100).

SOME JURISDICTIONS MAY NOT ALLOW CERTAIN LIMITATIONS, SO SOME PROVISIONS MAY NOT APPLY TO YOU.

13. Indemnification

You agree to defend, indemnify, and hold harmless GPN, Ceteris Partners LLC, and their affiliates, owners, employees, agents, contractors, and representatives from and against any claims, damages, liabilities, losses, costs, and expenses arising from:

• Your use of the Services
• Your User Content
• Your conduct
• Your violation of these Terms
• Your violation of any law or third-party rights

14. Termination

We may suspend, restrict, or terminate access to the Services at any time, with or without notice, for any reason or no reason. Upon termination, your rights under these Terms immediately end, certain provisions survive termination, and we may retain information as permitted by law.

You may stop using the Services at any time.

15. Governing Law and Venue

These Terms shall be governed by and construed in accordance with the laws of the State of South Carolina, without regard to conflict of law principles. Any dispute arising from or relating to these Terms or the Services shall be resolved exclusively in the state or federal courts located in South Carolina. You consent to personal jurisdiction and venue in such courts.

16. Arbitration and Class Action Waiver

To the fullest extent permitted by law, disputes arising from these Terms or the Services may be resolved through binding arbitration rather than court proceedings. Users waive any right to participate in class actions, class arbitrations, or representative proceedings.

Nothing in this section prevents either party from seeking injunctive relief or pursuing claims in small claims court where permitted.

17. Changes to the Services

We reserve the right to modify the Services, discontinue features, change pricing, add or remove functionality, and restrict access at any time without liability.

18. Changes to These Terms

We may update these Terms at any time. Updated Terms become effective upon posting. Continued use of the Services after changes are posted constitutes acceptance of the revised Terms.

19. Entire Agreement

These Terms, together with the Privacy Policy and any additional policies or agreements referenced herein, constitute the entire agreement between you and GPN regarding the Services.

20. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

21. Waiver

Failure to enforce any provision of these Terms shall not constitute a waiver of that provision.
